1. Acceptance of Terms

By accessing the Shivam Solar website (www.shivamsolar.com), requesting a site audit, or entering into an engineering contract for rooftop or ground-mounted solar power plants, you agree to be legally bound by these Terms and Conditions.

2. Quotations, Pricing & Validity

All commercial solar quotations provided via our interactive calculator or official technical estimates are subject to the following provisions:

• Online calculator figures are mathematical approximations based on average regional solar insolation (~4.5 peak sun hours) and standard Discom tariffs. Official binding quotations are issued following physical site survey validation.
• Formal written engineering proposals remain valid for 15 calendar days from issuance, given fluctuating global silicon wafer and commodity freight rates.
• Statutory taxes (such as GST on solar PV modules and electromechanical construction) are applied as per current Government of India notifications.

3. Site Access & Customer Responsibilities

To ensure smooth and timely project commissioning, the client agrees to:

• Grant unhindered access to the installation team to the designated terrace, roof, or land area during working hours.
• Ensure structural roof stability to bear module dead loads and wind uplift forces (Shivam Solar conducts non-invasive structural checks).
• Provide adequate single-phase or three-phase power and clean water access required during mounting, welding, and cable routing.
• Maintain unobstructed south-facing solar exposure and avoid erecting new shadow obstructions (such as large water tanks, antennas, or vegetation).

4. Government Subsidies & Net-Metering Approvals

Shivam Solar is an authorized empanelled installer under PM Surya Ghar: Muft Bijli Yojana. We manage end-to-end documentation, portal filing, meter procurement, and Discom inspection coordination. However:

• Subsidy Disbursement: Direct Benefit Transfer (DBT) subsidy payments are disbursed directly by the Government of India into the consumer's bank account. While Shivam Solar facilitates prompt approval, final release timelines depend on government nodal treasury schedules.
• Discom Sanctions: Final sanction of net-metering load is determined by the local electricity distribution utility based on local distribution transformer capacity constraints.

5. Warranties & Performance Guarantees

Our systems are built with Tier-1 components accompanied by industry-leading warranties:

• Solar PV Modules: 25 to 30 years linear performance warranty guaranteeing at least 80% to 87.4% rated power generation at Year 25, plus 10 to 12 years product manufacturing warranty.
• Solar Inverters: 5 to 10 years standard manufacturer replacement warranty with remote cloud diagnostics.
• Mounting Structures: 25-year structural integrity warranty against corrosion on hot-dip galvanized steel frames.
• Shivam Solar Workmanship: 1 to 5 years free comprehensive service and electrical connection warranty.

6. Limitation of Liability & Force Majeure

Shivam Solar shall not be held liable for generation loss arising from grid power outages by the state utility (on-grid inverters shut down for safety anti-islanding regulations), lack of periodic panel water cleaning, unauthorized tampering by third-party electricians, or Force Majeure events including earthquakes, cyclones exceeding design thresholds, or civil unrest.

7. Jurisdiction & Governing Law

These Terms and any contractual disputes arising out of solar engineering contracts shall be governed by and construed in accordance with the laws of India. Courts situated in Rajkot, Gujarat shall have exclusive jurisdiction.
